Access Legal Announces Appointment Of Nicholas Tubb To Medical Negligence Team

Access Legal from Shoosmiths, the national consumer legal services provider, has announced it has hired Nicholas Tubb as its new partner in the medical negligence team.

Tubb has joined Access Legal from Challinors’ clinical negligence department and will be based in Access Legal’s Birmingham office.

Tubb has considerable experience in the sector and has specialised in medical negligence claims on behalf of patients and their families for more than 10 years, with a particular interest in complex cases and a wide experience of claims involving surgical errors and deaths following treatment. He also has a keen interest in getting answers for patients and their families.

A partner since 2005, Tubb has successfully pursued complex birth injury, brain and spinal injury claims for clients, securing a number of multi-million pound awards.

He is a member of the Association of Personal Injury Lawyers, the Professional Negligence Lawyers Association, and is a panel member of AvMA (Action Against Medical Accidents).

The team at Access Legal from Shoosmiths is growing and Nicholas Tubb will strengthen its medical negligence offering.

Access Legal Announces Sponsorship of Leon Hunt

Access Legal, the consumer legal services provider, has announced it will be sponsoring motorcycle racer Leon Hunt in this season’s Metzeler National Superstock Championship.

Access Legal will be backing the 22-year-old from Brighton in all 12 rounds of the series, which began at Easter, at Brands Hatch. This is the first time that Access Legal has sponsored a rider.

Leon is racing for Lincoln-based team AP Kawasaki in the Superstock 1000cc class, which supports the popular MCE Insurance British Superbike Championship. He will be riding a brand new Kawasaki ZX-10R.

Leon began racing at the end of 2003, and has been successful on 125cc machines through to Superstock bikes. He won a 125 series and had podium positions in the British Championship, where he also enjoyed several top five finishes.

Access Legal also has a motoring law team, which is run by bikers and provides a service to bikers and other members of the public who have a motoring law question.

Simon Richards, team leader (legal executive) at Access Legal, said: “Being bikers ourselves, we follow the Superstock series avidly, and have known Leon for a couple of years. We’re excited to be able to get involved and we’re confident he’ll do well on the new ZX-10R. We wish him the best of luck for the series.”

Leon Hunt commented: “I really enjoyed my first year in the Superstock 1000cc class last year,” he said “but we had a little bit of bad luck and I had to train harder to get used to the longer races. I feel confident this season, and hope to be at the sharp end.”

The national law firm came top in a survey conducted by the Conveyancing Alliance which was voted for by estate agents. Users of the Conveyancing Alliance portal ranked law firms on several service standards including communication levels, speed of delivery and client feedback.

Client feedback was a key area for Access Legal, as it is very customer focused and aims to treat people as individuals rather than just another case.

Users of the Conveyancing Alliance portal then ranked law firms on service standards, which lead to Access Legal being awarded the top spot on the survey by estate agents in England and Wales.

Lawyers To Lawmakers: Reject Anti-Consumer Foreclosure Bill

A group of attorneys who represent foreclosure defendants around the state is calling on lawmakers to reject a proposed new law deceptively titled “Homeowner Relief and Housing Recovery Act” designed to change Florida’s foreclosure process from that is supervised by the courts, to a non-judicial process that would be entirely in the hands of the banks and mortgage companies from start to finish. Lawyers for Homeowners Rights or LHR-FL, a statewide coalition of consumer attorneys, will travel to Tallahassee on April 21 with homeowners to speak out against this anti-consumer legislation. According to Chip Parker, a Jacksonville attorney, “every Florida homeowner should be worried about passage of this bill”.

The two bills, HB 1523 by Rep. Tom Grady, R-Naples, and SB 2270, by Sen. Michael Bennett, R-Bradenton, will be considered this week by legislative committees. These two lawmakers want to allow mortgage companies to obtain foreclosure quickly so the home owned by a borrower who falls behind on their payments can be sold only after two letters sent by mail. If the homeowner does not respond or cannot pay what has been demanded by the bank, the house can be s sold -even if the homeowner is still living in it. There would be no independent review of any amounts claimed to be owed, or whether there has been a default under the mortgage, or even if the mortgage company has the right to foreclose even if there has been a mistake.

“It offends me that bankers can convince our lawmakers to use such blatantly misleading titles to legislation in a concerted effort to fool consumers,” said St Petersburg attorney Matt Weidner, who represents hundreds of homeowners across the state in foreclosure proceedings. “I see first-hand, every single day the profound effect the foreclosure crisis is having on consumers, institutions and our communities. This bill will do nothing to help homeowners.”

LHR-FL opposes the legislation saying that these institutions cannot be trusted with the foreclosure process pointing to a federal probe, recently reported in the Wall Street Journal, that is now underway and looking into alleged fraud by a Jacksonville, Florida company known as Lender Processing Services and its subsidiary Docx, LLC. These companies regularly prepare thousands of documents for banks and mortgage companies to be used in foreclosures all over the U.S., including at least one document that was prepared and filed in a Florida county showing that “bogus assignee” owned the mortgage. “Our lawmakers should not vote to trust the same people involved in that kind of activity. That is not good judgment in our view”, says Weidner.

Dominick Salfi, a former Circuit Court Judge in Seminole County, says “passage of this law would only worsen the abuse by mortgage companies”. He continues, “mortgage companies, banks and their lawyers are taking advantage of our overworked judges and their support staff who do not have sufficient hours in a day to thoroughly review each file.” LHR-FL argues that lawmakers who vote to put the foreclosure process in the hands of an industry that has shown little regard for the law, our courts and homeowner rights themselves risk being someday at the mercy of these institutions if mortgage payments are missed. “It’s a sobering thought. Even if you have faithfully paid for years into your mortgage, if something unexpected happens to you and cannot pay, or if the mortgage company mistakes you for someone else, it’s two notices and you’re out. That could happen to anyone, and it’s just not safe at all.” says Parker.

The Coming King Foundation (TCKF), A Texas Nonprofit Reached A Settlement Monday With Mesa Vista Landowners, Settling A 15-Month Property Dispute

A last-minute settlement agreement was presented to State District Judge Keith Williams on Monday, March 1st, as trial was about to get underway in the lawsuit brought by neighboring landowners against The Coming King Foundation (TCKF), a Texas nonprofit arts organization. TCKF plans to build a first class Sculpture Prayer Garden on 23 acres overlooking IH-10 and Highway 16, highlighted by the cross on top of a hill. Mesa Vista landowners suit prohibited the raising of the cross within the prayer garden.

The settlement agreement reached Monday allows the cross to be raised as planned putting an end to the 15-month property dispute and bringing peaceful a resolution and healing to this Texas Hill Country community.

Last month the Mesa Vista landowners lost their bid to have the case dismissed in their favor and Judge Williams ordered the trial to proceed on March 1st. Shortly thereafter, settlement negotiations were initiated by the landowners, which for the first time included an agreement to allow the cross to be raised on TCKF’s lot.“Once that point was conceded, both sides moved quickly to resolve differences and eventually agreed to a compromise”, said Kevin Young, attorney for TCKF. “We’re thankful that both sides could put away their swords and solve this in a Christian manner,” said Fern Lancaster, TCKF board member and treasurer.

“The Coming King Foundation will realize its vision of a cross and sculpture garden and the Mesa Vista residents will realize their goal of maintaining the privacy of their neighborhood,” said Mesa Vista homeowners’ attorney, Richard Mosty, in a prepared statement.

As part of the settlement, The Coming King Foundation will construct a solid fence on the site where the $2M, 70-ton cross will be located. The settlement also allows for lighting of the cross that is non-intrusive for residents of the subdivision and limited private access to the cross from Mesa Vista Lane, keeping the main entrance to the Garden on IH-10. In addition, TCKF will also pay the Mesa Vista neighbors $25,000 over the next several months as part of the settlement. Each side is responsible for paying its own attorney’s fees and legal expenses.

When asked whether he had won the case because the cross will go up, David Brock, co-counsel for TCKF said, “Everybody won. This agreement is respectful of everyone’s property rights and is better than a trial victory for either side.” TCKF board member and Vice President, Jim McKnight, added, “A peaceful resolution has been our desire and prayer since the lawsuit was filed. This is a great day for our community and now we can move forward.”

TCKF plans to raise the cross and complete the Garden as soon as sufficient funds are available. “Although we have incurred significant expense in our legal defense,” said TCKF board member and President Max Greiner Jr., “we are confident that God pays for what He ordains, and we invite our community, neighbors, friends and the greater Christian community to unite in support around this God-given vision and Sculpture Prayer Garden.”
